1. About these terms

These terms govern your use of this website and the advisory services provided by Elite Car Buying Advisors (ABN 78 428 528 602), trading as Elite Car Sales Advisors. By using this site you accept these terms. Where we agree a separate written engagement with you, that engagement prevails over these terms to the extent of any inconsistency.

2. What we do

We act for you, as the buyer. Our services may include:

• Helping you identify vehicles suited to your needs and budget.
• Approaching dealerships and sourcing comparable quotes on your behalf.
• Negotiating price, inclusions and on-road costs with dealerships.
• Presenting you with a written comparison and recommendation.
• Introducing you to the chosen dealership once you have approved a deal.

3. What we are not

We are not a car dealer, and we do not buy, sell, own or supply vehicles. We are not a finance broker, insurance broker or credit provider, and nothing we say is financial, credit, legal or taxation advice. We do not conduct mechanical inspections; where one is appropriate we will tell you, and you should engage a qualified inspector.

Any vehicle purchase contract is formed between you and the supplying dealership. We are not a party to it. Warranties, statutory guarantees, delivery obligations and after-sales service are matters between you and that dealership and its manufacturer.

4. Fees and how we are paid

• You pay us. Our fee is payable by you, the customer. We accept no commission, referral fee, kickback, volume bonus or other benefit from any dealership, manufacturer, finance provider or insurer in connection with your purchase.
• Agreed up front. We will quote our fee and confirm it in writing before we begin work. We will not begin chargeable work until you have accepted it.
• Not contingent on a sale. Our fee is for the work we do, not for a car being sold. What happens if you decide not to proceed, including any amount payable for work already completed, will be set out in that written quote before you accept it.
• The initial call is free. Your first 60-minute consultation carries no charge and no obligation.
• Fees are in Australian dollars. Payment terms are as stated on our invoice.

5. No obligation to purchase

You are under no obligation to buy any vehicle we source or recommend, at any stage. You may decline every quote presented, choose a different vehicle, buy elsewhere, or stop the process entirely. We will tell you when we think not buying is the better decision.

6. Your responsibilities

• Give us accurate and complete information about your needs, budget and timeframe.
• Review any quote, contract or document before you sign it. Signing is always your decision.
• Tell us promptly if your requirements change or you no longer wish to proceed.
• Make your own enquiries about finance, insurance and vehicle condition.

7. Quotes, pricing and availability

Quotes we obtain come from third-party dealerships and are subject to their terms, stock availability and validity periods. Prices, incentives, lead times and availability can change without notice and are outside our control. We do not guarantee that any particular price, vehicle or delivery date will remain available, or that any specific saving will be achieved.

8. Communication

We communicate by email and by scheduled Microsoft Teams meetings. We do not operate a phone line. This is deliberate: it keeps the terms of your deal in writing. You are responsible for monitoring the email address you give us.

9. Liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded.

Subject to that, our liability for any claim arising out of our services is limited, at our option, to re-supplying the services or refunding the fees you paid us for them. We are not liable for the acts or omissions of any dealership, manufacturer, finance provider, insurer or inspector, or for indirect or consequential loss.

10. Intellectual property

The content, branding and design of this website belong to us and may not be reproduced without permission. Any written comparison or recommendation we prepare is for your use only.

11. Privacy

We handle personal information in accordance with our Privacy Policy, including our commitment not to pass your contact details to a dealership until you have approved a deal.

12. Changes and governing law

We may update these terms from time to time; the current version is always on this page. These terms are governed by the laws of Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
